Resolucijo smo podpisali skupaj z še nekaterimi drugimi vACC, pričakujemo podpise še iz drugih držav. Čeprav je resolucija objavljena na internetu, jo vseeno objavljam tukaj

Vojaška resolucija 1.16.03.03.001.
Pričujoči dokument je bil sprejet s strani FIR-ov omenjenih v dokumentu. Nekateri FIR-i niso sprejeli vseh členov resolucije, zato lahko vsebina delno variira. Z obiskom vseh omenjenih FIR-ov boste lahko videli celotno resolucijo.
Ker gre za mednarodno resolucijo, jo objavljamo v angleščini.

Resolution v.1.16.03.03.001.

Proclamation regarding new joint resolution restricting military and
alike activity in the following FIRs

LJLA, LDZO, LQSB, LYBA, LWSK, … (more pending)

as well as flights cariing a political message

Purpose of this resolution:

Avoiding possible conflicts by setting extended regulations based on existing VATSIM/VATEUR(D) policies.

Temporal and spatial validation:

This Resolution will be enforced within the boundaries of FIRs/countries who had accepted it in the full context. The Resolution is presented as is and will be in effect as far as parties who signed it do not resolve otherwise.

Article 1

Resolution is banning all military flights (except national ones in their own airspace) within the boundaries of FIRs/countries who accepted the Resolution.

By term &aircraft& this Resolution recognizes any mean available for airborne activity or any other object, controlled by humans in the air or ground control, guided or unguided and corresponding to the terms below.
Constituting Military flights are:

~ all flights performed by an aircraft or a group of aircraft who are equipped with bays and slots which can be used (by manufacturer specs) for carrying and/or releasing weapons and/or any other means which released upon humans may cause injure or death, regardless of the nature of flight of such aircraft and regardless of current weapons configurations.

~ all flights performed by an aircraft or a group of aircraft which are used or hired (in any way) by foreign military for support, intelligence, logistical or other purposes. (refueling aircrafts, AWACs…)

~ all flights performed by an aircraft or a group of aircraft which indicate in any way (flightplan / remarks / callsign / voice-text comms…) any link to any foreign military, their operations, fields of operations or any designators connecting it to such foreign force.

~ all flights performed by an aircraft or a group of aircraft which indicate a load or passengers that corresponds to the terms in the above restrictions

~ all flights performed by an aircraft of a group of aircraft who do NOT meet the restrictions above, but who (in any time sequence of their transit through FIR/country) in any way indicate such (restrictions above!) compliances will be considered Military flights

Article 2

No Military flights will be allowed to Depart, Transit or Arrive FIRs/Countries in question.

Article 3

This Resolution is in effect regardless of availability of Air traffic Control services in the Area, 24 hours a day, 7 days a week for indefinite period of time.

Article 4

Aircraft approaching prohibited airspace will be warned by local ATCs (if not already by FIR ATC they are currently in) of this Resolution.

Aircraft already located in the prohobited airspace (no previous ATC, but now present) will be warned about this Resolution and requested to leave the airspace at the nearest point.

Article 5

Airspace of Bosnia and Herzegovina has NATO zones. Limited military activity is available in those zones if NATO control is online and if such flights are in contact with NATO control. Flying outside NATO zones in BiH is prohibited.

NATO BiH Control is located in Zagreb, Croatia (R/L Based!)

Military zones in other countries are subject of internal appendix to this Resolution. All FIRs/countries who sigh this Resolution shall be informed about any appendix issued by any FIR/country.

Article 6

Aircraft (from Articles 4, 7) refusing to comply with the ATC request will be asked to disconnect.

Aircraft (from article 6, Section 1 and Article 7, section 1) will be disconnected by means of Supervisor. Official complaints will be filed.

Article 7

Aircraft carrying a political message will be asked to disconnect or leave the area.

Constituting political messages are:

~ all notes, remarks, comms (both text and voice) presented by the pilot(s) which are real-life based and/or may be interpreted as a provocation.

~ any (political) remarks made by the pilot about world sensitive areas

~ and action made by the pilot about similar designations (Article 7, Section 2)

Article 8

Local ATCs are obliged to warn inbound (to another, unmanned FIR/Country who had accepted the Resolution) banned flights about the resolution and act accordingly (restrict the flight from entering prohibited zones).

Article 9

NO EMERG landings are allowed for banned flights (as described in Article 1, 7) in FIRs/countries who signed the Resolution. Such flights will be advised to land at nearest foreign airport. (Such flights are not supposed to be in the area anyway!)

Closing Article

This Resolution represents official vACC Document, approved by vACC Director(s) and is in effect from the date of releasing.

This Resolution is obligatory to all vACC members as is to all other VATSIM members entering FIRs/countries in question

Exceptions to this Resolutions are not allowed unless:

~ Military flights are performed by military force of a country who had signed and started to enforce this Resolution, AND such flights are pre-announced and approved by visiting-vACC Staff. (e.g. Hungarian Mil Training flight over East Croatia and west Yugoslavia)

~ the same are defined by an appendix, issued by local FIR/country

This Resolution v.1.16.03.03.001. is signed and approved by Slovenian vACC Director, mr. Goran Brumen and IS valid vACC Document. As such this document shall be base for any online activity within LJLA airspace, restrictive, disciplinary or any other.

Spoštovani letalci!

Resolucijo umikamo zaradi tega, ker je pravzaprav že zajeta v osnovnih pravilih VATSIMa, hkrati pa obstaja velika verjetnost, da bi vrh VATSIMa protestiral proti njej.
Po detaljnem pregledu VATSIM-EUR pravil v njih piše takole:

Citiram:
Military Flights are allowed in VATSIM Europe Division as long as they:
do not interfere with civilian flights
are not on combat missions
do not interfere with politically sensitive matters / areas in real world
do not have a political message passed by their activity
follow standard IFR or VFR routes, or
follow different routes only after controller approval (if present).
Aerial refueling, formation flying, precision approach, cargo and similar flights are allowed. Aircraft type does not matter as long as it follows the above rules.

ATC should ask what is the "purpose" of the flight's mission. If the response of the "flight leader" does not seem to be in accordance with the above, then records should be taken (VATSIM ID, Radar Snapshots, Callsign etc) and reported to DCRM for further action. Online verbal conflicts must be avoided.

Torej vojaški leti so dovoljeni, dokler potekajo po pravilih civilnega letenja, vojaške akcije pa so prepovedane. Vseeno pa člane vACC Slovenije pozivam, da naj se vzdržijo vojaških poletov, saj je Evropski prostor je trenutno zelo napet v pričakovanju vojne v Iraku in lahko kogarkoli v Evropi prehitro zanese.
